Thank you for contacting me about visa requirements for Polish citizens traveling to the United States. I appreciate hearing from you on this important issue.
Established in 1986, the Visa Waiver Program (VWP) enables nationals of Canada, Mexico, and 34 other countries to travel to the U.S. for tourism or business for up to 90 days without obtaining a visa. There are specific requirements for countries to be part of the VWP. A country must offer reciprocal privileges to U.S. citizens; certify that it issues or will issue tamper-resistant machine-readable passports; have a nonimmigrant refusal rate of less than three percent; must not compromise the law enforcement or security interests of the U.S. by its inclusion in the VWP; and other factors.
I understand your concerns about the different treatment the citizens of Poland experience as compared to the citizens of other European countries. Poland has been a strong ally of the U.S., and our country has benefited from Poland’s steadfast support. In 2005, the U.S. began providing “road maps” toward meeting VWP requirements to 13 additional countries, including Poland. The “Secure Travel and Counterterrorism Partnership Program Act of 2011” (S. 497) would alter current VWP requirements, changing the refusal rate maximum to an overstay rate maximum. Under this bill, Poland would be eligible for the VWP. This legislation is currently pending before the Senate Judiciary Committee, of which I am not a member.
Please be assured that I will continue to monitor the expansion of the VWP and will keep your views in mind should the full Senate consider this or other legislation on this issue.
